1. Acceptance of Terms

By accessing and using the Khajalaya Delivery App ("the App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms & Conditions ("Terms") govern your use of our mobile application and related services provided by Khajalaya Delivery App ("Company," "we," "us," or "our").

Khajalaya Delivery App is a food delivery platform that connects users with local restaurants and food vendors. Our service includes:

3. User Accounts

6. User Conduct

  • Impersonate another person or entity
  • Post false, misleading, or harmful content

7. Intellectual Property

The app and its original content, features, and functionality are owned by Khajalaya Delivery App and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 User Content

By submitting content to our app (reviews, photos, etc.), you grant us a non-exclusive, royalty-free license to use, modify, and distribute such content for our business purposes.

9. Disclaimers and Limitations

9.1 Service Availability

9.2 Limitation of Liability

To the maximum extent permitted by law, Khajalaya Delivery App shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of the app.

Our app may integrate with third-party services. We are not responsible for the availability, content, or practices of these third-party services.

10. Indemnification

You agree to indemnify and hold harmless Khajalaya Delivery App, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising out of or relating to your use of the app or violation of these Terms.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting our customer support team.

11.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11.3 Effect of Termination

Upon termination, your right to use the app will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive termination.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the app shall be resolved through binding arbitration in accordance with the rules of the Nepal Arbitration Association.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by:

Your continued use of the app after any changes constitutes acceptance of the updated Terms.

14. Severability

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Khajalaya Delivery App regarding the use of the app and supersede all prior agreements and understandings.
